What Does An Immigration Lawyer Do?
An immigration attorney has quite a unique role in comparison to other kinds of lawyers. That is because most immigration attorneys devote their time to assisting clients who are experiencing issues due to the requirements of the U.S. government. At Toland Law, LLC, our attorneys will act as an advisor and will provide legal counsel as you go through the process and have to deal with the immigration authorities.
While we don’t focus on civil court matters, we do take on the role of mediators for our clients when they are interacting with the United States Citizenship and Immigration Services (USCIS). However, we are also ready at any moment to represent our clients in immigration court should a hearing be needed.
How Much Does An Immigration Attorney Cost?
While there is no standard fee for working with an immigration lawyer in Boston, it should be noted that because each case is unique, the fee structure will be different as well. These fees are dependent on whether or not there are complications involved, additional research, visa applications and more.
The fees will also vary if you choose a more complex form of immigration. While we cannot provide a fee estimate at this moment, we will be happy to discuss any costs with you during a consultation.
How Can Someone Immigrate To The United States?
There are currently a few different ways to immigrate to the United States and they include the following:
- Family-based, such as green cards attained via marriage and fiancé visas
- Employment-based is available for workers with varying skills that are needed in specific fields, as well as having an employer sponsor a worker to become a permanent resident.
- Student visas for those who wish to study in the United States
- Asylum
- Temporary Protected Status
- Work visas
- Investment
- And more
How Long Can I Expect The Process To Take?
Applications for visas are processed based on their priority date and in order of when they are received. The priority date varies on the kind of visa that was applied for.
For example, the priority date for family-based applications is when the petition was filed properly. For employment visas, the priority date is either the same day the petition was filed or the date the labor certification was approved.
When the number of applicants exceeds the number of visas available, the category is considered “oversubscribed,” which means applicants will be forced to wait until visas are available before coming to the U.S. As of this moment, all family preference categories are oversubscribed and the wait for visa approval can from to 2 to over 20 years.
What Is A Biometric Screening?
A biometric screening is an appointment that typically occurs a few weeks before your visa interview. At this screening, you will be asked the USCIS to provide information including your fingerprints, a photo, and a signature for them to keep on file.
After the screening is done, you will be given a stamp that proves you attending the screening, you will need to keep this on file in the event that the USCIS loses the form or is unable to track it down.
The fingerprints collected at this screening will be sent to the Federal Bureau of Investigation (FBI), who run them through their records. These fingerprints will also be sent to the USCIS, who will check to see that you have never been caught illegally crossing the border or any other crime that may affect your application being passed.
How Can I Get A Permit To Work In The U.S.?
To obtain a work permit, also known as an Employment Authorization Document, an applicant will need to fill out Form I-765, pay the appropriate fee, and provide photos and additional documentation that proves your eligibility to the USCIS.
This form, the fees, and documents will need to be sent via mail and the address can be found on their website. Make sure that you keep a copy of everything!
