Client charged with OUI at the Waltham District Court
Client was involved in an accident and admitted to drinking 2 beers at the scene with 2 police officers. He consented to perform field sobriety tests to which he allegedly performed extremely poor on. The officers claimed he had a strong odor of alcohol on his breath, glassy bloodshot eyes, slurred speech, and that he was unsteady on his feet. The officers brought him to the booking station where he was also observed on video as well. The client was found Not Guilty after the Jury was deliberating for only 10 minutes.
Client charged with OUI at the Dedham District Court
A caller called the police to inform them that my client was throwing up on the side of the road and passed out in his vehicle with the engine running. The police showed up to his location and woke up my client while he was in his car. The officer asked my client if he had anything to drink and he said he was drinking a lot the night before. The officer had him step outside and perform some field sobriety tests. The officer claimed that my client was under the influence based on his observations of the field sobriety tests, alcoholic breath, bloodshot glassy eyes, and slurred speech. The whole incident was recorded on the police officer’s cruiser cam. After heavily cross-examining the officers and at the close of evidence, the jury found my client Not Guilty.
Client charged with 2 cases of Domestic Violence at the Lowell District Court
My client was in a horrible relationship with his now ex-girlfriend who was trying to get my client deported. She claimed that my client on two separate incidents committed acts of domestic violence in the form of punching and strangulation. There was heavy evidence of the ex-girlfriend bringing forth false charges based on revenge. I able to discredit the testimony of the ex-girlfriend and show the lack of investigation on the side of the police. The jury found my client Not Guilty on both cases.
Two convictions vacated for prospective lawful permanent resident
My client had two serious convictions including Assault and Battery with a Dangerous Weapon at the Boston Municipal Court – Brighton Division and Drug Distribution in the Quincy District Court. My client was married to a U.S. Citizen and had 3 U.S. citizen children. His wife would be able to sponsor him for lawful permanent residency (green card) but these criminal convictions made him inadmissible which means he could not obtain lawful permanent residency. I filed two motions to vacate his convictions based on ineffective assistance of counsel and the cases were reopened and charges were dismissed. He was then able to have his wife sponsor him to obtain his lawful permanent residency and stay with his family.
Client in Removal Proceedings wins cancellation of removal resulting in a grant of Lawful Permanent Residency (Green Card)
My client was in ICE detention because of his criminal history and his hope of staying in the country was dwindling. He came from his home country when he was 17 years old and was living in the United States for over 20 years. He had a 10 year old U.S. Citizen child who he would not be able to raise if he was to be deported back to his home country. After I vacated one of his criminal convictions, he was eligible to apply for Cancellation of Removal for Non-Lawful Permanent Residents. After my client was in ICE detention for 9 months and a very tough hearing, the Immigration Judge approved his case for Cancellation of Removal resulting in a grant of Lawful Permanent Residency for him. He is now living free in the United States with his family and most importantly his child.
Drug Distribution Case Dismissed at Boston Municipal Court – East Boston Division
My client was driving in a car and the police saw another individual enter my client’s car. The other individual was only in the car for about 5 minutes and then left the vehicle. The police stopped that individual and found cocaine on his person. This individual claimed it was my client who sold him these drugs. I scheduled the case for trial and the case was ultimately dismissed.
Leaving the Scene of Property Damage and Negligent Operation of a Motor Vehicle – Cambridge District Court
My client was allegedly involved in a serious accident and fled the scene. The license plate at the scene that fell off the vehicle was registered in the name of my client. After the police questioned my client at this house and spoke with other witnesses, they ultimately charged him with Leaving the Scene of Property Damage and Negligent Operation of a Motor Vehicle. The case was ultimately dismissed.
Drug Distribution Case Vacated at Middlesex Superior Court
My client was a lawful permanent resident with a lot of family here. He has been in this country since he was 2 years old. About 5 years ago he was indicted and charged with a very strong drug distribution case. He ultimately pleaded guilty but without the knowing the grave immigration consequences. He pleaded to an “aggravated felony” for immigration purposes and when ICE finally arrested him, he was placed in removal proceedings. Given that he had an aggravated felony, he was ineligible for any forms of relief and was ordered removed from the country. During the time he was waiting to be removed from the country, I filed a motion to vacate his conviction which was strongly opposed by the prosecution. After questioning the previous attorney, the Judge ultimately found that the attorney was ineffective and did not provide my client any of the collateral immigration consequences as a result of his plea. The conviction was vacated and the case was resolved in a manner with the prosecution where my client would not suffer any immigration consequences and be able to stay with his family.
OUI Vacated at the Fall River District Court
My client was on DACA (Deferred Action for Childhood Arrivals) and he was convicted of an OUI. One conviction of an OUI will revoke a person’s status on DACA. ICE ultimately arrested him and placed him in removal proceedings. During his stay in detention, I filed a Motion to Vacate his conviction and we were successful. The conviction was vacated and he was released from detention and reunited with his family.
